BOSTON, Feb. 8 (UPI) - A Massachusetts judge has refused to throw out a suit against the makers of Newport cigarettes, accusing cigarette makers of targeting children.
Court documents show Marie Evans - who has died since filing the action against the Lorillard Tobacco Co. - had said she could remember getting free samples of smokes when she was as young as 9, the Boston Globe reported.
The lawsuit, which is being continued by Evans' son, will be the country's first alleging tobacco companies lured children into smoking with free samples, the Globe said.
Lorillard said in court papers it should not be held responsible for any damages that occurred after 1969, when cigarettes started to carry warning labels. Evans' smoking-related health problems didn't begin until 1984, when she had a heart attack, Lorillard's lawyers said.
